Terms and Conditions
By the use of our website, by using one or more of our products, and/or by placing an order with us, you expressly agree to be bound by and abide by our terms and conditions outlined below, including a mandatory arbitration provision and a class action waiver provision.
These terms contain a mandatory arbitration provision, which includes a class action, class arbitration, and jury trial waiver. These provisions require the use of arbitration to resolve disputes, rather than jury trials or class actions. Our terms also include policies for order cancellation, returns, warranty claims, shipping, privacy, crash replacement, limitation of liability, and more. Mandatory Arbitration for U.S. Users
You and we agree that all disputes between you and us (whether or not such dispute involves a third party) with regard to your relationship with us (including disputes related to this agreement, your use of Luxon MX products, and/or rights of privacy and/or publicity), will be resolved exclusively by binding arbitration, except that you may assert claims in small claims court if your claims qualify. You and we each agree that class or representative arbitrations, as well as class or representative actions, are not permitted under any circumstances, and that you and we are each waiving the right to participate in a class action or class arbitration.
You and we each agree that you and we are further waiving our respective rights to sue or go to court to assert or defend our rights under this user agreement. You and we each agree that the federal arbitration act and federal arbitration governs the interpretation and enforcement of this provision.
For all disputes, whether pursued in small claims court or arbitration, you must first give us an opportunity to resolve your claim by sending a written description of your claim to:

We each agree to negotiate your claim in good faith. If we are unable to resolve the claim within 60 days after we receive your written description, you may pursue your claim in arbitration.

Product Warnings and Limitation of Liability
Luxon MX products are designed for closed course competition only and do not comply with federal motor vehicle safety standards. Luxon MX products may not be used on public roads, streets, highways, or freeways.
Installation of Luxon MX product must be performed by a trained professional. Luxon MX's installation instructions must be followed. In the event installation instructions are not available for a particular product, the OEM motorcycle's installation instructions must be followed along with standard professional mechanic standards including the use of appropriate thread locking agents, thread anti-seize agents, and torque specifications as applicable. Failure to follow the installation instructions, apply standard professional mechanic procedures, and/or perform routine inspections and maintenance can result in injury or death.
Motocross is an inherently dangerous sport. The end user of Luxon MX products assumes all risk and liability in their installation, maintenance, and use. There are no guarantees associated with Luxon MX products.
In no event shall Luxon MX, its staff, owners, employees, contractors, suppliers, or associates be liable for any damages whatsoever (including without limitation, special, incidental, consequential, or indirect damages or any pecuniary loss) arising out of the use of Luxon MX product.

Warranty
We will warranty parts on a case by case basis in the event of a manufacturing defect or other problem that is not the fault of the customer. Unfortunately, we do not warranty parts that break in crashes (see our Crash Replacement Program details below), due to misuse, or improper maintenance. Luxon MX reserves the right to refuse a warranty for any reason. Motocross is a tough sport, and our customers bear the sole responsibility of the installation and/or usage of our products.
